Terms
General principles
These Terms & Conditions (hereinafter referred to as “T&Cs”) constitute the legal framework in which SARL MAISON B sells wine as specified for each and every offer. All sales of wines made by SARL MAISON B are therefore governed by the T&Cs. The act of placing an order therefore implies that the purchaser fully and unconditionally accepts these T&Cs.
Law
These T&Cs are subject to the application of French law. All contractual information is presented in French and all products offered for sale comply with French legislation. If applicable, the foreign buyer is responsible for checking with the local authorities for the possible uses of the product they intend to order. SARL MAISON B cannot be held liable in the event of non-compliance with the regulations of a foreign country where the product is delivered. Any dispute arising between the customer and our company shall be submitted to the jurisdiction of Bordeaux Trade Tribunal.

All online reservations are subject to final confirmation by Maison B. All our offers are subject to availability, provided that the item has not been sold in the meantime and does not constitute a firm commitment.
Reservations, once confirmed, will be considered as orders. Orders are confirmed by the sending of the invoice but are only final upon receipt of the total payment of the goods. The order placed by the buyer is subject to written confirmation by the seller at the following email address: contact@maison-b.com.

Primeur wines
Unless otherwise agreed with SARL MAISON B, orders for primeur wines are subject to payment of the full invoice. Payments must be made no later than thirty days after receipt of the invoice.
Pricing
The prices communicated by the seller are per bottle, and in the specified format. The prices expressed refer to goods available at the seller’s warehouse (Ex Works), excluding taxes (VAT is at the expense of the buyer) and in Euros (€). They do not include transport, customs fees or insurance, which remain the responsibility of the buyer.
Payment
All order payments must be made in full either by bank transfer to SARL MAISON B (bank details communicated to buyers upon request) or by cheque made payable to SARL MAISON B. Payments must be made within eight days of receipt of invoice and before collection. Payments may not be postponed without our prior express permission.
SARL MAISON B reserves the right to refuse any order from a buyer who has failed to pay a previous invoice (totally or partially). We also reserve the right to suspend the order and delivery of goods without offering compensation.
Deliveries & Collection
Sales concluded with SARL MAISON B are Ex-Works – i.e. transport costs to the delivery point are the responsibility of the buyer. Parties may derogate from this clause by mutual agreement.
The buyer has a period of two months from the delivery date of the order to claim the goods. After this period, storage and insurance costs will be automatically invoiced by the seller. Storage of the wine will no longer be covered by our insurance policy.
We highly recommend that the buyer takes out specific insurance covering the transportation of their wines at the time of collection.
Receiving an order
Upon receipt of the goods, the buyer – or any third party designated by the latter such as the carrier or authorised warehouse-keeper – must check the nature, condition, quantity, quality and, the conformity of the wines delivered with the content of the order in question.
The buyer is responsible for recording all necessary observations should any of the goods be missing or damaged, by expressing their reservations on the delivery slip and within 48 hours of receipt of the goods by registered letter with acknowledgement of receipt to the carrier, a copy of which will be sent to the seller, in order to protect their rights. After the 48-hour period, no complaint shall be taken into account.
Late or default payment
SARL MAISON B reserves the right to cancel any unpaid orders within fifteen days following the original payment deadline stipulated on the invoice. In the event of a payment delay exceeding thirty days following this formal notice, and without call for any other form of formal cancellation, SARL MAISON B reserves the right to: cancel the sale or continue the sale on the basis of the current applicable exchange rate. In the latter case, the buyer is responsible for paying the updated price.
Quality – Responsibility
Despite our wines being stored in ideal conditions in our cellars, it is impossible to guarantee the perfect quality and condition of vintages over ten years old. Corked bottles may under no circumstances be exchanged.
Returns
Wines cannot be returned without the prior written consent of SARL MAISON B.
Retention of title – Risk transfer
SARL MAISON B reserves the right to retain ownership of goods until the invoice and any additional costs have been paid in full.
The risks of loss and deterioration of the sold goods are transferred to the buyer as soon as they receive them.
Protection of minors
In accordance with the provisions of Article L 3342-1 of the Public Health Code, which prohibits the sale of alcohol to minors under 18 years of age, the buyer certifies, by validating their order, that they are at least eighteen years of age on the day the order is placed.
